No point in killing him, you would just release him from all his responsibilities. Just think about it, what is a harsher punishment? Being killed or rotting in jail for years and having to think about what you've done for the rest of your life? Which one of these is the easier one for the murderer in your opinion? He will have to live with that act for the rest of his life in contaiment.

Well it depends on how the prisons are over there, america has some of the worst prisons when it comes to violence and stuff like that.

I wonder if they can give this guy the death penalty.

No. Only certain places even have the death penalty. You need some really hard evidence to even get considered for the death penalty. In most cases killing 1 person will not get you the death penalty.
